Abstrak

Makalah ini memfokuskan isu mengenai takrifan fraud sebagai pengecualian kepada prinsip hak milik tidak boleh disangkal di bawah seksyen 340(2) dengan memberikan penekanan kepada pengaruh notis terhadap kepentingan tidak berdaftar. Analisis terhadap kes yang telah diputuskan oleh mahkamah dan pendirian mahkamah mengenai kedudukan pihak yang mempunyai kepentingan yang tidak berdaftar di Malaysia dilakukan dengan melihat secara holistik  tentang pentingnya “pengetahuan atau notis” kepada kepentingan yang tidak berdaftar dalam konsep hak milik tidak boleh disangkal mengikut undang-undang tanah. Penulisan ini mengutarakan beberapa cadangan penambahbaikan bagi melindungi kepentingan yang tidak berdaftar tersebut.

Abstract

This article analyses the definition of fraud as an exception to the principle of indefeasibility of title under section 340(2) NLC with special reference to the effect of  notice on  unregistered interest. An analysis of decided cases regarding court standing as to the position of unregistered parties in Malaysia is also made for a holistic look at the importance of  “knowledge or notice” of unregistered interest in the concept of indefeasibility of title according to land law. This article also highlights some proposed solutions for the protection of unregistered interest.
